Terms of Service

Welcome to IVOIRE. These Terms of Service (“Terms”) apply to your use of ivoireswim.com (the “Site”) and to any purchase you make from us. The Site is operated by [LEGAL BUSINESS NAME], doing business as IVOIRE and Ivoire Swim (“IVOIRE”, “we”, “us” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who Can Use the Site

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, you may use the Site only with the involvement of a parent or guardian who agrees to these Terms. You agree to give us accurate and complete information when you create an account, join our list or check out, and to keep your account details secure.

2. Our Pieces

We try to show every piece as accurately as possible. Colours, prints and fabrics can look different from screen to screen, and because many of our details are made by hand, small variations from piece to piece are part of their character, not a defect. Measurements in our Size Guide are a guide only.

All pieces are sold for personal use. IVOIRE does not sell wholesale, and we may refuse or cancel orders that appear to be placed for resale.

3. Prices and Payment

Prices are shown in US dollars and do not include shipping or applicable taxes, which are calculated at checkout. We may change prices at any time, but changes will not affect orders already confirmed. Payment is processed securely at checkout by our payment providers. By placing an order, you confirm that you are authorised to use the payment method you provide.

If a piece is listed at an incorrect price or with incorrect information because of an error, we may cancel the order and refund any payment you made for it, even after you have received an order confirmation.

4. Orders

Your order is an offer to buy. We accept it when we ship it, or for pre-orders, as described below. We may limit quantities, refuse or cancel any order, including orders we believe are fraudulent or placed in breach of these Terms. If we cancel an order you have paid for, we will refund you in full.

5. Pre-Orders

Some pieces, including Collection Blue, are offered on pre-order before they are available to ship. When a piece is on pre-order:

• Its expected shipping window is shown on the product page (for Collection Blue, February 2027).
• You are charged in full at checkout when you place your pre-order.
• If your order includes in-stock pieces as well as pre-order pieces, everything ships together when the pre-order pieces are ready.
• Shipping dates are estimates. If production is delayed, we will let you know by email. If a pre-order piece can no longer be made, we will cancel it and refund what you paid for it.
• Any gift or incentive offered with a pre-order (for example, the Collection Blue calendar for the first pre-orders) is available while supplies last and has no cash value.

Early access for list members is offered at our discretion and may be limited in time or quantity.

6. Shipping

We ship to the addresses and countries offered at checkout. Delivery times are estimates and are not guaranteed. Risk of loss passes to you when your order is handed to the carrier. If your order arrives damaged or is lost in transit, please contact us within 7 days of delivery, or of the expected delivery date, and we will work with you and the carrier to put it right. International customers are responsible for any duties, taxes and customs fees charged by their country.

7. Returns and Exchanges

We offer exchanges or store credit only. We do not offer refunds, except where an order is cancelled by us or where required by law.

• Return requests must be made within 7–14 days of receiving your order through our Start a Return page.
• Pieces must be unworn, unwashed and stain-free, in their original packaging with the hygiene liner, IVOIRE hang tags and garment bag intact.
• A flat fee is deducted to cover your return label.
• Sale items and orders placed with a discount code follow the same policy.
• Once we receive and inspect your return, your exchange or store credit is processed within 8 days.
• We may refuse returns that do not meet these conditions and send them back to you.

Store credit has no cash value, cannot be transferred and is applied to future purchases on the Site.

8. Promotions and Discount Codes

Discount codes and promotions are subject to the terms stated with them, may not be combined unless we say so, have no cash value and may be withdrawn or changed at any time. We may cancel orders that use codes in a way we did not intend.

9. Emails and Texts

If you join our list, we will send you emails and, if you opt in, text messages about IVOIRE, early access, pre-orders and promotions. Message frequency varies, and message and data rates may apply. Consent to receive texts is not a condition of purchase. Reply STOP to any text to opt out, or click “unsubscribe” in any email. How we handle your information is explained in our Privacy Policy.

10. Our Content

Everything on the Site, including the IVOIRE name and logo, piece names, designs, prints, photographs, films, labels, packaging and text, belongs to IVOIRE or our licensors and is protected by intellectual property laws. You may view and share it for personal, non-commercial purposes. You may not copy, reproduce, sell or use it for any other purpose without our written permission.

11. Your Content

If you tag IVOIRE on social media, send us photos or reviews, or otherwise share content with us, you give IVOIRE a non-exclusive, royalty-free, worldwide licence to use, display and share that content on the Site, in emails and on our social media, with credit to you where practical. You confirm that you own the content or have permission to share it, and that it does not infringe anyone else’s rights. We will always ask before using your content in paid advertising.

12. Using the Site

You agree not to misuse the Site, including by attempting to interfere with its security or operation, using automated tools to scrape it, uploading harmful code, or using it for anything unlawful. We may suspend or end your access if you breach these Terms.

13. Third-Party Services and Links

The Site uses third-party services, such as Shopify for our store and checkout and payment and shipping providers, and may link to other websites such as social media. We are not responsible for third-party websites or services, and your use of them is subject to their own terms.

14. Disclaimer

The Site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, IVOIRE makes no warranties of any kind, express or implied, about the Site, including that it will be uninterrupted or error-free. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded.

15. Limitation of Liability

To the fullest extent permitted by law, IVOIRE will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our pieces. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

16. Indemnity

You agree to indemnify and hold IVOIRE harmless from any claims, losses or expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.

17. Governing Law

These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in [COUNTY, STATE], unless the law where you live requires otherwise.

18. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the date at the top will show when they were last updated. The Terms in effect when you place an order apply to that order.
